Joycon drift problem dragging other companies in?

There was recent reports that Microsoft is facing a lawsuit about their controllers drift problems, mainly with the Xbox Elite 1 and 2 controllers. It seems Nintendo Switch's Joycon drift problems is causing a stir about other controllers facing similar problems. I for one know all too well, Xbox, PlayStation and most other companies that make controllers, will experience some sort of drift problems with their controllers.

Could this mean more controller makers could face controller drift lawsuits if they're not repaired for free? Nintendo takes Joycons in for free repair if it shows signs of analog drift, could Sony and Microsoft be forced to do the same?
